Scope of these terms

These Terms govern the supply of interior finishing services by Choiceimpact across Australia, including plastering, painting, plasterboard finishing, carpentry finishing, and decorative works. By engaging our services you accept these terms.

  • Estimates and quotes are valid for the period stated on the document.
  • Work will be performed in accordance with applicable Australian standards and local regulations.
  • Site access, safety, and readiness are the client's responsibility unless otherwise agreed.
Project scope

Australian consumer guarantees

Under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), consumers have guarantees including services being rendered with due care and skill, being fit for purpose and delivered within a reasonable time. Nothing in these terms attempts to exclude or limit those guarantees where prohibited by law.

Where a failure to comply with consumer guarantees occurs, we will, at our option, remedy the service, supply again, or provide a refund as required by law.

Privacy & personal information (Australia)

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our detailed practices are set out in our Privacy Policy available at privacy.html.

  • We collect only necessary information to provide and invoice our services.
  • We retain records for legal and warranty purposes and protect data with appropriate security measures.
  • Individuals have rights to access and correct personal information; requests should be directed to our contact channels.

Intellectual property

All designs, drawings, imagery, and content produced by Choiceimpact remain our intellectual property unless a separate written assignment is agreed. Clients are granted a non-exclusive licence to use deliverables for the purpose for which they were supplied.

Reproduction, resale or distribution of our materials without permission is prohibited.

Limitation of liability

Subject to the Australian Consumer Law and other mandatory provisions, our liability for breach of these Terms or for negligence is limited to the supply of the services again or payment of the cost of having the services supplied again. We are not liable for indirect or consequential loss, except where prohibited by law.

Clients must notify Choiceimpact in writing of any claim within a reasonable time and provide reasonable assistance in investigating matters.

Detailed clauses

Standard payment terms are as specified on invoices. Deposits may be required prior to commencement. Quoted prices exclude unforeseen variations and third-party charges unless stated.

We provide workmanship warranties where applicable and as specified in project documentation. Warranty claims require evidence and access for assessment; remedies will follow statutory entitlements.

Choiceimpact holds appropriate public liability insurance. Clients must ensure safe access and remove hazards prior to works. Additional costs for hazardous site remediation are payable by the client.

Complaints, dispute resolution & contact for legal matters

If internal resolution is unsuccessful, parties may agree to mediation or pursue remedies under Australian consumer protection laws. For residential building disputes in NSW, parties may also apply to the NSW Civil and Administrative Tribunal where applicable.

Complaints handling

Governing law & severability

These Terms are governed by the laws of the State of New South Wales, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales. If any provision is held invalid or unenforceable, it will be severed and will not affect the remainder of these Terms.

Changes to this page

We may update these legal terms from time to time. Material changes will be posted on this page with an updated date. For contractual certainty, the version referenced in your quote or contract will apply to that engagement.
